This web site (the “Site”), is owned and operated by The MAP Agency LLC (“MAP”, “we”, “our” or  “us” ) By accessing or using this Site, you agree to be bound by the following terms and conditions (the “Terms of Use”) and the terms and conditions of our Privacy Notice, which is hereby incorporated by reference (collectively, this “Agreement”). We reserve the right, at our discretion, to change any of these terms in the future. If you do not agree to these Terms of Use, you may not access or otherwise use the Site or the Services.

SERVICES FOR REGISTERED USERS. The MAP Agency operates an electronic platform/system that connects smart women (“Providers”) seeking to re-establish their professional career with companies that are hiring. ( “Services”) through the Site. The material on this Site includes general non-proprietary information available to all users of the Site, but in order to access and use the Services you will be required to register on the Site.  If you register to use the Services you may be required to agree to additional terms and conditions in connection with the registration process (the ” Services Agreement”).

RESTRICTIONS. In accordance with Federal Children’s Online Privacy Protection Act of 1998 (COPPA), we will never knowingly solicit, nor will we accept, personally identifiable information from users known to be under thirteen (13) years of age.

INTELLECTUAL PROPERTY. The MAP Agency is the owner and/or authorized user of all trademarks, logos, service marks and trade names (collectively the “Trademarks”) on the Site, and is the owner or licensee of the content and/or information on the Site. Except as otherwise expressly provided herein, or pursuant to the Terms and Conditions, your use of the Site does not grant to you a license to any content or materials you may access on the Site. Nothing contained on the Site should be construed as granting any license or right to use any Trademark displayed on the Site without our written permission or that of the third party rights holder.

COMMUNICATIONS TO THE MAP AGENCY AND USER GENERATED CONTENT. Although we encourage you to e-mail us, you should not e-mail us anything that contains confidential information. Please refer to our Privacy Notice with regard to how we handle your personal information. With respect to all e-mails you send to us, including but not limited to feedback, questions, comments, suggestions, and the like, we shall be free to use any ideas, concepts, know-how, or techniques contained in your communications for any purpose whatsoever, including but not limited to, the development, production and marketing of products and services that incorporate such information.

The MAP Agency does not and cannot review all communications and materials posted to or created by users accessing the Services (hereinafter, “User Generated Content”), and is not in any manner responsible for the content of the User Generated Content. The MAP Agency reserves the right to block or remove communications or materials that it determines to be in violation of our Community Guidelines or is offensive or otherwise unacceptable to The MAP Agency in its sole discretion.

You Must Insure That Your Personal Information Is Accurate and Current. Our business depends on our ability to provide true and accurate information to our Users. We may also have obligations under the law to report any fraud, forgery, or other illegal activities. To use certain Services, you may be required to provide us with information about you, which may include personal identifying information, some of which may be confidential in nature (“Personal Information”). By becoming a User of The MAP Agency website you confirm that you understand that we have these obligations to our other Users. If you provide Personal Information to us then you agree to provide true, current, complete and accurate information, and not to misrepresent your identity. You also agree to keep your Personal Information current and to update your Personal Information if any of your Personal Information changes. Our collection, use and disclosure of your Personal Information is governed by these Terms and our Privacy Policy. If you have any questions about our role, please contact us and ask before you sign-up.

You own the rights to anything you post to the Services, including text and photographs. You do, however, grant us an irrevocable, non-exclusive, worldwide, perpetual, royalty-free license to use, modify, copy, distribute, publish, perform, sublicense, and create derivative works from all submissions you provide to us, in any media now known or hereafter devised.

You Are Responsible for Keeping Your Password Secure. If our Services require you to create a password to use certain portions of our Services, then it is your sole responsibility to maintain the security of that password. You agree that we shall not be liable for any loss that you may suffer as a result of the authorized or unauthorized use of your password by a third party. You must not allow any person under the age of 18 to use any of our Services via your registration or password.

You Are Responsible for Notifying Us of a Breach. You agree to immediately notify us of any unauthorized use of your password, any unauthorized use of any account that you may have with us, any violation of these Terms, or any other breach of security known to you in connection with any product or service available on our Services by sending an email to: info@mapsc.net

EXCLUSIVITY, NON-SOLICITATION, AND NON-CIRCUMVENTION.  By using any of the Services, you confirm that you are not an employee of any staffing agency, headhunter or similar organization, and you agree that you will not perform any services commonly associated with staffing agencies, headhunters or similar organizations, directly or indirectly, on or through this website.  You agree not to use this website or the Services for the purposes of circumventing or attempting to circumvent The Map Agency Services, including for the purpose of avoiding the obligation to pay any of The MAP Agency fees related to its provision of the Services.  You agree not to circumvent the payment methods offered by the website and you will notify The MAP Agency immediately if another party improperly contacts you or suggests making or receiving payments outside of the Site. You agree that you will not under any circumstances:

(i) Submit proposals to, solicit, contract, hire, manage or pay any parties identified through our Services other than through this website; or

(ii) Accept proposals from, contact, deliver services to, invoice or receive payments from parties identified through the Services other than through this website.

COMMUNITY GUIDELINES. While using the Site and the Services, you agree not to: use the Site or the Services in violation of any applicable law; use the Site or the Services or features in violation of The MAP Agency or any third party’s intellectual property or other proprietary, personal or legal rights; obtain or attempt to obtain unauthorized access to computer systems, materials, information or any Services made available on or through the Site through any means; attempt to gain unauthorized access to other computer systems through the Site; impersonate any person or entity or misrepresent your affiliation with any other person or entity; attempt (or encourage or support anyone else’s attempt) to circumvent, reverse engineer, decrypt, or otherwise alter or interfere with the Site or the Services, or any content thereof, or make unauthorized use thereof; use the Site in any manner that could damage, disable, overburden, or impair the Site or interfere with any other party’s use and enjoyment of the Site; obtain or attempt to obtain any materials or information through any means not intentionally made publicly available or provided for through the Site.

THE FOLLOWING TERMS APPLY SPECIFICALLY TO BUSINESSES.  Businesses are solely responsible for the Positions they post on this website. The MAP Agency is not your agent or the agent of any of its Users, and The MAP Agency will not be responsible for any employment or contracting decisions, for whatever reason, made by any entity posting Positions on this website.    You understand and agree that The MAP Agency is not a party to any Position. Providers are not employees or agents of The MAP Agency, and we do not, in any way, supervise, direct, or control work provided by Providers.    The MAP Agency will not have any liability or obligations under or related to Positions. The MAP Agency has no control over Providers, and makes no representations as to the integrity, reliability, capability, or qualifications of any Provider or the quality, security or legality of any Provider’s work in connection with any Position.  The MAP Agency makes no representations as to the truth or accuracy of information provided by this website’s Users, the qualifications, background, or identities of Providers, the ability of Providers to perform the work required by any Position, or that a Provider can or will actually complete a transaction. The MAP Agency does not and is not required to verify any information given to us by our Users, nor does The MAP Agency routinely perform background checks on Providers.

Posting Positions

A Position posting may not contain:

  • material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under 18
  • any hyperlinks, other than those specifically authorized by The MAP Agency
  • inaccurate, false, or misleading information; and

You also may not:

  • post Positions that do not comply with applicable laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property;
  • post jobs or advertisements for competitors of The MAP Agency or post Positions that contain a link to any site competitive with The MAP Agency
  • post Positions that require citizenship or lawful permanent residence in any particular country as a condition of employment, unless otherwise required in order to comply with law, regulations, executive order, or federal, state or local government contract
  • sell, promote or advertise products or services;
  • post any franchise, pyramid scheme, “club membership”, distributorship, multi-level marketing opportunity, or sales representative agency arrangement;
  • post any Position that requires an up-front or periodic payment or requires recruitment of other members, sub-distributors or sub-agents;
  • post any Position that pays commission only, unless the posting clearly states that the available position pays commission only and clearly describes the product or service that the Provider would be selling;
  • post Positions that include any screening criterion where such criterion is not an actual and legal requirement of the posted Position;
  • endorse a particular political party, political agenda, political position or issue;
  • promote a particular religion; and
  • except where allowed by applicable law, post Positions that require the Provider to provide information relating to her (i) racial or ethnic origin (ii) political beliefs (iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.
  • The MAP Agency reserves the right to remove any Position or content from our website, which in the reasonable exercise of The MAP Agency’s discretion, does not comply with the above Terms, or if any content is posted that we believes is not in the best interest of The MAP Agency
  • If at any time during your use of our Services, you made a misrepresentation of fact to The MAP Agency or otherwise misled The MAP Agency in regards to the nature of your business activities, we will have grounds to immediately terminate your use of the Services.

NO WARRANTIES. WE AND OUR SERVICE PROVIDERS MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE CONTENTS OF THE SITE OR THE SERVICE. WE SHALL NOT BE SUBJECT TO LIABILITY FOR ANY DELAYS OR INTERRUPTIONS OF THE SITE OR THE SERVICE FROM WHATEVER CAUSE. YOU AGREE THAT YOU USE THE WEBSITE, THE SITE’S CONTENT, AND THE SERVICE AT YOUR OWN RISK. THE SITE AND THE SERVICE MAY CONTAIN TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS OR OMISSIONS. MHE IS NOT RESPONSIBLE FOR ANY SUCH TYPOGRAPHICAL OR TECHNICAL ERRORS. MHE RESERVES THE RIGHT TO MAKE CHANGES, CORRECTIONS, AND/OR IMPROVEMENTS TO THE SITE AND THE SERVICE AT ANY TIME WITHOUT NOTICE.

EXTERNAL WEBSITES. The Site may contain links to third-party websites (“External Websites”). These links are provided solely as a convenience to you and not as an endorsement by us of the content on such External Websites. We are not responsible for the content of any linked External Websites and do not make any representations regarding the content or accuracy of materials on such External Websites.

INDEMNIFICATION. You agree to defend, indemnify, and hold us and our officers, directors, employees, successors, licensees, service providers, and assignees harmless from and against any claims, actions, or demands, including, without limitation, reasonable legal and accounting fees, arising or resulting from your breach of this Agreement or your access to, use, or misuse of the The MAP Agency Content, the Site, or the Service. We shall provide notice to you of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit, or proceeding. We reserve the right to assume the exclusive defense and control of any matter that is subject to indemnification under this section. In such case, you agree to cooperate with any reasonable requests assisting our defense of such matter.

COMPLIANCE WITH APPLICABLE LAWS. We control and operate the Site from our offices in the United States of America. We do not represent that materials on the Site are appropriate or available for use in other locations. Persons who choose to access the Site from other locations do so on their own initiative, and are responsible for compliance with local laws, if and to the extent local laws are applicable. All parties to these terms and conditions waive their respective rights to a trial by jury.

TERMINATION OF THE AGREEMENT. Subject to the terms of the Services Agreement, if applicable, we reserve the right, in our sole discretion, to restrict, suspend, or terminate this Agreement and your access to the Services and/or all or any part of the Site, at any time and for any reason without prior notice or liability.

MISCELLANEOUS. If any provision of this Agreement is found to be invalid by any court having competent jurisdiction or terminated in accordance with the Termination provision above, the invalidity or termination of such provision shall not affect the validity of the following provisions of this Agreement, which shall remain in full force and effect: “Intellectual Property,” “Communications to MAP Agency,” “No Warranties,” “Indemnification,” “Termination of the Agreement,” and “Miscellaneous.” Our failure to act on or enforce any provision of the Agreement shall not be construed as a waiver of that provision or any other provision in this Agreement. No waiver shall be effective against us unless made in writing, and no such waiver shall be construed as a waiver in any other or subsequent instance. Except as expressly agreed by us and you in writing, this Agreement constitutes the entire Agreement between you and us with respect to the subject matter, and supersedes all previous or contemporaneous agreements, whether written or oral, between the parties with respect to the subject matter. The section headings are provided merely for convenience and shall not be given any legal import. This Agreement will inure to the benefit of our successors, assigns, licensees, and sublicensees.
